Require the Secretary of State to set prescribed safety requirements for e-scooters offered for sale, including limits on speed and power output; to prohibit the marketing, sale and supply of e-scooters for use on roads or other public places where such use is unlawful; to prohibit the sale and supply of equipment capable of modifying an e-scooter to circumvent prescribed safety requirements; to make provision about consumer information requirements for the sale of e-scooters; to confer powers on trading standards officers and constables to enforce compliance; and for connected purposes.

Be it enacted by the King’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—
1 Prescribed safety requirements for e-scooters (1)

The Secretary of State must by regulations prescribe safety requirements applicable to e-scooters (“the prescribed safety requirements”).

 (2)

Regulations under this section must include requirements relating to—

 (a)

maximum speed,

 (b)

maximum power output,

 (c)

braking systems,

 (d)

lighting and visibility,

 (e)

construction standards, and

 (f)

such other matters as the Secretary of State considers necessary for the safe operation of e- scooters.

 (3)

A person must not manufacture, import, offer for sale, sell or supply an e-scooter unless it complies with the prescribed safety requirements.
2 Prohibition of modification equipment (1)

A person commits an offence if that person manufactures or offers for sale any equipment, including conversion kits, designed or intended to modify an e-scooter so that it ceases to comply with the prescribed safety requirements.

 (2)

Subsection (1) applies where the modification would affect—

 (a)

maximum speed,

 (b)

maximum power output,

 (c)

braking or safety systems, or

 (d)

any other characteristic relevant to compliance with prescribed safety requirements.
3 Consumer information requirements (1)

A person who offers for sale an e-scooter must provide consumers with clear and prominent information concerning the lawful uses of the e-scooter.

 (2)

A person commits an offence if that person fails to comply with subsection (1).
4 Prohibition of the marketing, sale and supply of e-scooters for unlawful road use (1)

A person commits an offence if that person is responsible for the marketing of e-scooters in a manner that would lead a reasonable person to believe that the e-scooter may lawfully be used on a road or other public place where such use would be unlawful.

 (2)

For the purposes of subsection (1), marketing includes—

 (a)

words, images, videos or other promotional material;

 (b)

product descriptions;

 (c)

any other form of communication to current or prospective customers.

 (3)

E-scooters that meet the prescribed safety requirements may continue to be sold for use on private land with the landowner's permission.
5 Seizure of non-compliance e-scooters (1)

Where a trading standards officer or constable has reasonable grounds to believe that an e-scooter offered for sale does not comply with the prescribed safety requirements, the officer or constable may seize that e-scooter.

 (2)

A e-scooter seized under this section may be retained pending determination of whether it complies with the prescribed safety requirements.
6 Penalties

A person guilty of an offence under sections (2), (3) or (4) of this Act is liable on summary conviction to a fine not exceeding level 3 on the standard scale.
7 Regulations (1)

Regulations under this Act are to be made by statutory instrument.

 (2)

A statutory instrument containing regulations under this Act may not be made unless a draft has been laid before and approved by a resolution of each House of Parliament.
8 Extent, commencement and short title (1)

This Act extends to England and Wales and Scotland.

 (2)

This Act comes into force at the end of the period of six months beginning with the day on which it is passed.

 (3)

This Act may be cited as the E-Scooters (Safety and Sale) Act 2026.
