    <subsection GUID="_bad2a2a1-11dd-4a44-aac5-f2d30340df0d" class="prov2" eId="sec_1__subsec_1">
     <num><?L 1-2?>(1)</num>
     <content>
      <p>The functions of the Youth Justice Board for England and Wales (“the Board”) <?L 1-3?>under section 41(5) and <ref class="valid" href="#sec_3__subsec_1__qstr__subsec_5A" ukl:targetGuid="_0fc51913-1a79-491a-adbc-06ef76a4513e" ukl:targetJref="">(5A)</ref> of the Crime and Disorder Act 1998 are to be <?L 1-4?>undertaken primarily by the Board.</p>

    </subsection>
    <subsection GUID="_6ee554b5-f099-4a6e-9cf8-fd02872711af" class="prov2" eId="sec_1__subsec_2">
     <num><?L 1-5?>(2)</num>
     <content>
      <p>The Secretary of State must, within six months of the passing of this Act, <?L 1-6?>agree a memorandum of understanding with the Board and the Welsh <?L 1-7?>Government setting out how responsibility for delivering youth justice services <?L 1-8?>in England and Wales is to be divided between the Board, the department <?L 1-9?>and the Welsh Government, and which ensures that the functions mentioned <?L 1-10?>in <ref class="valid" href="#sec_1__subsec_1" ukl:targetGuid="_bad2a2a1-11dd-4a44-aac5-f2d30340df0d">subsection (1)</ref> are primarily undertaken by the Board.</p>

      <p>The Secretary of State must, within one year of the passing of this Act, make <?L 1-12?>arrangements for those functions to be undertaken in accordance with the <?L 1-13?>memorandum of understanding under <ref class="valid" href="#sec_1__subsec_2" ukl:targetGuid="_6ee554b5-f099-4a6e-9cf8-fd02872711af">subsection (2)</ref>.</p>

         <p>The following functions shall, so far as exercisable in relation to the <?L 2-4?>youth justice system, be exercisable by the Youth Justice Board for <?L 2-5?>England and Wales concurrently with the Secretary of State, namely—</p>

          <p>the functions conferred on the Secretary of State by section <?L 2-7?>12(2) of the Prison Act 1952 (place of confinement of prisoners);</p>

          <p>the function, conferred on the Secretary of State by section <?L 2-9?>36(1) of the Prison Act 1952, of purchasing land by agreement;</p>

          <p>the functions conferred on the Secretary of State by sections <?L 2-14?>80 and 81(1)(a) and (2) of the Criminal Justice Act 1991 (escort <?L 2-15?>arrangements) and any function exercisable by the Secretary <?L 2-16?>of State in relation to arrangements under section 80, including <?L 2-17?>the procurement of, and the making of payments under, such <?L 2-18?>arrangements;</p>
