The Higher Education and Research Act 2017 is amended as follows.

Make provision in relation to introducing an international element and greater course choice in higher education and research in the United Kingdom; and for connected purposes.
B e it enacted by the King’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—
The Higher Education and Research Act 2017 is amended as follows.
In section 2(1)(c) (general duties), after first “providers” insert “, as well as
with higher education providers established outside the United Kingdom,”
In section 2(2)(c) (general duties), after “courses” insert “, online courses,
courses provided in collaboration with the private sector, certified extramural
or informal courses and international courses”.
In section 38(1)(d) (duty to monitor etc the provision of arrangements for
student transfers), for “may” substitute “must”.
In section 38(2)(a) (duty to monitor etc the provision of arrangements for
student transfers), at end insert “or from a course (“course A”) provided by
a higher education provider established outside the United Kingdom to a
different course (“course B”) provided by a receiving provider in the United
Kingdom,”.
In section 39(1) (financial support for registered higher education providers),
for “either or both” substitute “any”.
In section 39(1) (financial support for registered higher education providers),
at end insert— “(c) the provision of programmes for international student
transfers, including through online learning and research.”
This Act extends to the United Kingdom.
This Act comes into force on the day on which this Act is passed.
This Act may be cited as the International Higher Education and Research
Act 2023.
